Performance Audit Reports

The Ontario New Home Warranty Program (ONHWP) requires a mandatory independent inspection of the common elements of all condominiums with at least one residential unit.

As prescribed in the Condominium Act, 1998, the purpose of the Performance Audit is to determine whether there are any deficiencies in the performance of the common elements, as defined in the description of the condominium, that may result in a claim against the guarantee fund administered by the Warranty Program.

Kleinfeldt Consultants has performed hundreds of building audits over the last 40 plus years of operation. These include Condition Assessments, Technical Audits, Life-Safety Audits and Performance Audits. Our staff includes Professional Engineers, Engineering Technologists and Building Scientists.

In addition to the detailed site inspections and reporting required to conduct the Audit, Kleinfeldt Consultants also provides the depth of experience required for the conciliation process and, where necessary, mediation and litigation proceedings.

The building and site elements are covered under the Warranty Program for specific conditions and time frames:

• First Year
General warranty covering building code infractions and design deficiencies;

• Two Years
Warranty coverage for water penetration into the building envelope, along with health and safety violations and mechanical systems failures;

• Seven Years
Warranty coverage for major structural defects.

Accordingly, the Warranty Program should be notified in writing regarding warrantable defects during the above time periods. We are also dedicated to providing the ongoing support required to ensure that covered repairs are either repaired by the builder or paid for by the ONHWP within the limits of the Program.
