Pre-Start Health & Safety Review - PHSR

A Pre-Start Health and Safety Review (PHSR) is mandatory in Ontario. PHSRs are law; when a piece of equipment is moved into a new workplace or if a safety control has been added or modified, a PHSR is required to audit that piece of equipment. Old equipment must comply with the OHS Act. If older equipment must be modified to comply to the safety requirements of the OHS Act it also requires a PHSR. Its purpose, in accordance with the Ontario Health and Safety Act, is to identify the equipment's hazard potential, and uncover any deficiencies concerning compliance. Likewise, if a process is to be constructed, added or installed or a new process is used, a PHSR is required to ensure the process is safe. PHSR results are presented to management, who in turn team up with the Joint Health and Safety Committee to establish an action plan to implement safety measures.

Ontario PHSRs must be performed by a professional engineer registered in Ontario. In some (rare) cases, a technical person can undertake PHSR performance. At Kleinfeldt, our PHSR professional engineers hold Certificates of Authorization issued by PEO (Professional Engineers Ontario).

Many companies are not aware of the potential fallout of omitting PHSRs. If an accident occurs or a complaint is issued and the Ministry of Labour investigates, production can be halted until a professional engineer signs off on the problem. If failure to observe basic due diligence is found, and if a serious injury occurs, the Ministry of Labour can fine or imprison owners, managers or even supervisors. Maximum individual fine amounts are set at $25,000 and maximum prison sentences are 12 months. Corporation fine maximums, however, are $500,000. Under Bill C-45 if criminal negligence is established the maximum prison sentence is 10 years and for organizations found guilty of indictable offences there are no maximum fines. Worse, however, is carrying the knowledge that a preventable accident occurred because of your carelessness, resulting in one of your employees either dying or sustaining immeasurably life-altering injuries.
